Understand The Officer's Perspective With A Pennsylvania DUI

Avoid A DUI In Pennsylvania By Knowing What The Officer Is Looking For

Being stopped for a Pennsylvania DUI is a frightening experience. To help calm your nerves when being pulled over under suspicion of a DUI in Pennsylvania, it is helpful to know how to react. Understand the warning signs the officer will be looking for to determine if you should be arrested for a DUI in Pennsylvania.

If you know that you have been drinking and are facing a possible Pennsylvania DUI, the best response when questioned by the officer is “I would like to speak to my attorney before answering any questions.” Be sure to be polite when making this request.

In the meantime, the officer will be looking for a number of signs to determine if he or she should move forward with your Pennsylvania DUI arrest. These symptoms include:

  • Bloodshot eyes that are watery, red, or glassy
  • Flushed face
  • Slurred speech
  • The smell of alcohol
  • Appearing unbalanced or stumbling when exiting the vehicle
  • Fumbling with a wallet or purse when getting a license
  • Difficulty understanding the questions asked by the officer
  • General instability or swaying when standing
  • Leaning on the car for balance or support
  • Appearing disoriented about the place and time
  • Disorderly clothing
  • Inability to properly follow the officer’s directions
  • Inappropriate attitude – such as being argumentative or excessively happy

By doing your best to limit these symptoms of intoxication, you just might be able to avoid a Pennsylvania DUI arrest.

UPDATE: A revision to Pennsylvania Law has been proposed to change DUI (Driving Under the Influence) to DAI (Driving After Imbibing). This will cause sweeping changes to Pennsylvania DUI laws and present many challenges to defense lawyers, prosecutors and the courts. This matter is still pending.
