Use PA Drunk Driving Laws In Your Favor
Rather Than Against You
As with any state, PA drunk driving laws can work in your favor --- if you know how to properly use them. But, if you are not familiar with Pennsylvania DUI case law, you might make a mistake when you get pulled over that could be quite costly.
One area of PA drunk driving laws that is helpful to understand is related to field sobriety testing.
When an officer pulls you over and asks you to perform a field sobriety test, PA drunk driving laws state that you are not obligated to comply. Therefore, you can politely refuse to perform the test.
If, however, you do decide to comply with the request, the National Highway Traffic Safety Administration offers only three approved sobriety tests that can be used, according to Pennsylvania DUI case law. These are:
- One-leg stand
- Heal-to-toe (also called the walk-and-turn)
- Horizontal Gaze Nystagmus
According to PA drunk driving laws, all other types of field sobriety tests are disapproved. This is because all other forms are objective and do not provide a numerical score as with testing results.

UPDATE: A revision to Pennsylvania Law has been proposed to change DUI (Driving Under the Influence) to DAI (Driving After Imbibing). This will cause sweeping changes to Pennsylvania DUI laws and present many challenges to defense lawyers, prosecutors and the courts. This matter is still pending. |
